Notice period is only based on concept that mangament should know who is exiting, and they can manage the work on his absence or can make alternate arrangement.
as concern for leave , candidate can availe due leave (EL/PL) whatsoever balance on his account.

This depends on your company's policies on leave. Normally the policy contains a clause stating that the employee shall not avail any leave (especially privilege or earned leave) on resignation. This is with a view for smooth handing over of the work handled by him prior to his leaving the company.

During Notice Period No Leave Is Permissible And One Has To Serve The Period Of Notice As Per Terms Of Employment Depending Upon The Status Ie Probationer Or Regular Employee.

Hi, I am Asim from Pakistan and working in a bank. As per my understanding the leaves during the normal service cannot be availed at the sole descretion of the employee. It requires employers approval. The benefits like outstanding leaves collapse immediately upon tendering notice of resignation from service on following grounds (Suppose one months notice is tendered and same no of leaves are available on employees account):
1) Notice is served to enable the employer to arrange for appropriate substitution for the post. If the employee proceeds on leave the purpose of notice period spoils.
2) If the employee proceeds on leave, he (most probably) may join another job thus working on the strength of two employers at a time which is certainly againt law of land.
However the court's deceision must be respected. I doubt that Labor Court's decesion would have come under different circustances and conditions.
