Dear Seniors,

I work for an consulting company and my salary structure is as following:

Gross salary - INR 3,12,000
Bonus** - INR 1,00,000
**Bonus will be paid at the end of one year from the date of joining.

My date of joining was Dec 05, 2007. I get INR 26,000 per month. During one discussion recentely with my company authority, I was told that my bonus is based on performance. I told them that nowhere it is written in the salary structure provided to me. Then they told me that it was printed by mistake. Now they are also telling me that I was told on phone before joining about the bonus. Accordingly I should get the bonus after the Dec 04, 2008. I am totally being cheated here and becaseu of this I am very much disturbed. I am not able to understnad what should I do and how should I handle this case to get my bonus as mentioned in the salary structure. Kindly advice me for the same. I would be very much grateful to you.

Kick the company and move on... Else come to terms with it and stay on... The choices are pretty simple!

I think you may have a final discussion with your superior and finalise it. If nothing is against you, then you may go to the labour court, keeping in mind that you are very confident about the bonus that you will get on Dec. 4, 2008. Otherwise, ask for a written statement (reason) about the exact date of bonus & then go for labour if need arises or if you are desperate. But see to it that, they mention the present date.

Being a lawyer as well, I wouldn't advise you to go to court (unless you are a rich guy, of course!). But, the company is always stronger than you are. And there are several provisions that can be used against you. Note that the rules and policies of companies are many times formulated in such a way so as to work around situations like yours.
Like I said, I suggest you move on to another company. That will be the best solution. Fool me once, shame on me... Fool me twice, shame on me!!!

I think you should speak to your supervisor and try to find out a solution. In the meanwhile, keep on looking for a good opportunity because by now they also know that come whatever may, you will not stay back. So better is to spend time and move on as soon as you get a good opportunity.

If its clearly written in the app letter ,the co needs to abide by the statement..also chk ur bonus policy and whether there a clause in ur app letter at the end mentioning that the above clauses will be as per cos internal polices..(then there is a gap).
Flash the app letter for better review of ur querry.also talk to ur immediate superior and HR ...then talk to ur MD/CEO.ask for clarifications,seek answers...going to court is baseless ,though i agree u need to fight for ur rights...but try to find a amicable way...and then move out of this org...or stay and create a diffrence and message for others frm ur exp.
I am sure this CO s is not the BEST PLACES TO WORK...this co is a small fly by night operator org,a organisation without ethics and values...very few organisation give such cheap treatmeant to employees..specially when Talent attraction and retention is so Imp TODAY...

Dear Everybody,

I am very much thankful to you for your suggestions.

Basically I belong to a lower middle class family and am not financially well. That is why I fear with court's matter. I also fear that they (company) may frame me in some false matter if I go to court.

I was thinking to visit my home in this month and for that I had applied for leave of 10 days on last Friday Oct 31, 2008. Actually I have not used my leave more than 3 days in the whole year while per month 1.5 days leave is allowed. Today one my superior called me up and told me that I am being given notice period of 15 days because my performance is not as per the company expectation and I should search some other job. When I tried to talk on bonus and cash for remaining leave, he told me that I would not be paid for the remaining leave because I would be under notice period from tomorrow. About bonus, he told me that since bonus is based on performance, I will be given calculated amount based on the performance.

As per bonus policy of the company, "Payment of any bonus compensation shall be at the sole discretion of the Board of Directors or the Executive committee of the Board of Directors and the Executive shall have no entitlement to such amount absent a decision by the company as aforesaid to make such bonus compensation."

However I have not lost my efforts but I am totally helpless. I am getting bad paid for my loyalty and hard work. This would be very bad experience of my career.

My dear,court isn't the final option...,in your organisation u may developed some good relation with your colleageus and superior.first of all,discuss with them and u may automatically get the company policy and the reason why the company doing so with u.after all u have to talk with ur superior (who is the company employee) convience him,take him in ur trust.In this case,superior is the best weapon for u...HO SAKTA HAI KI BAAT BANJAYE......!!!!!!
