Plz let me know the following:-
(i) Whether P F/ Factories Act will be applicable if the Factory building is under construction through a contractor who is employing 15 workers & the owner does manufacturing activity on trial basis with only 5 workers?
(i) Whether contract workers will also be counted for the applicability of Industrial Employment (Standing Orders) Act,1946 ?

:blink:after complition of factory you have to apply for factory licence showing details of drawing & factory information
:wacko:pf is applicable only when mfg process is with aid of power & 10 or more worker are working, otherwise 20 employees without aid of power
PF is not applicable for the contract employees who involved in construction of factory building or any erection work as they are not our employees. But if the contract employees are involved in manufacturing activity or used for the purpose intended for the main activity of the factory, the management should ensure that the contractor pays PF for the workers under him or otherwise we have to deduct the PF portion from the contractor's payment and remit to the department.
PF is not applicable for employees less than 20 nos. But if the company wishes to give the benifit of PF, we can.
