Dear Ld. HR Members,
Plz let me know the following:-
(i) Whether P F/ Factories Act will be applicable if the Factory building is under construction through a contractor who is employing 15 workers & the owner does manufacturing activity on trial basis with only 5 workers?
(i) Whether contract workers will also be counted for the applicability of Industrial Employment (Standing Orders) Act,1946 ?

PF is not applicable for the contract employees who involved in construction of factory building or any erection work as they are not our employees. But if the contract employees are involved in manufacturing activity or used for the purpose intended for the main activity of the factory, the management should ensure that the contractor pays PF for the workers under him or otherwise we have to deduct the PF portion from the contractor's payment and remit to the department.
PF is not applicable for employees less than 20 nos. But if the company wishes to give the benifit of PF, we can.

You have asked two questions:

1. Is PF applicable for the construction of Factory on workers of the contractor building the factory? and
2. whether COntractor workers be counted for the applicability of industrial Employment Standing ORder Act?

I will answer the 2nd question first. The Industrial Employment Standing order Act defines workmen as per the Industrial Disputes Act. Hence for someone to be defined as workmen he must pass the following test
a) He must be an employee not having supervisory responsibility or if he has Supervisory responsibility then his wages must be below Rs.1600/- per month.
Applying this test to your case the employees of the contractors are not employees of Company whose factory is being constructed. Hence the contractors workers will not be counted for applicability of the Industrial Employment Standing Orders ACT.

b) As far as your 1st Question is concerned it does not make a difference if the factory has started manufacturing or not. For a factory or office the moment the minimum number of employees are working in the premises the PF act becomes applicable. Even if all the employees are through a contractor the PF act will be applicable. This is because the PF act does not differentiate how the workers/ employees have been apppointed - directly or indirectly through a contractor. It merely says that once the number of employees are more than 10 PF will be applicable.

Thanks for your response on the PF query and i am not sure whether Khola has received his answer, but i am bit interested in your points. On the whole my assumption is that Khola's establishment is out of the PF applicability.
But your first point seems mystic to me. Would u mind explain it again for me.

This is Venugopal..I have one doubt in PF, please clarify my doubt
if the company having 30 employees in those, 15 are permanent and the remaining 15 are in prohibition. so prohibition employees are also eligible for PF or not?
