Dear all. i had one doubt in ESI-rule. If one employee wage increase to 10,000 in Jan-09. IE he cover under our medical claim policy as default. but my question is? whether we should remit the ESI for the month of NOV&DEC or not?.

Dear if the salary is increased to 10000 still the employee shall be under the coverage of ESIC because the ceiling limit is 10000 for esic. Otherwise if it is more the 10000 then still the contribution need to be paid for the rest of the contribution period i.e upto march-09. If any one;s wages increses the ceiling lime of the esic in between the contibution period then still the contribution is to be made till the end of the contribution period. The contibution period is from Apr-Sep and Oct-Mar.

Because there are two contribution i.e. 1st April to 30 September and 1st October to 31st March. Any employee who ceased to be member of ESI has to contribute throughout any of the contribution period. Hence the employee who has ceased to be member in Jan need to pay his contributions till 31st March. Of course employer also has to pay its share of contributions.

Dear Anil, Absolutely, you need to pay the employee as well as employer contribution till March -09, if the increment is effective from Jan-09. Regards Sreekumar

in this case u will have to continue with the esi deduction AND SUBMIT IT TO the govt..till the end of period..i.e. from october to march...and plz dnt ever do a lethal mistake of collecting/deducting the ESi amt n not submitting the same to govt via challan..

i have one dout .i,e if any employee joined on 01.01.2009, when we shall apply esi form 01 to esi office. & when we shall give esi card to that employee.

Hello all
I have one doubt plz clear it.... My company follows shops & est. act Harayana. plz look at d salary heads of my company first:
Basic
HRA
Conveyance allowance
Medical allowance
Special allowance
we deduct esi on the above total that becomes our gross salary. so should medical allowance be added for esi deduction?
Above all, we have mediclaim policy of Rs.1 lac per employee in our company for all employees.
Now plz tell me are we doing right as we r deducting esi by adding all the heads. or medical allowance or any other head should be excluded from the gross salary for esi deduction????

You should not deduct ESI from medical allowance only from Basic,DA,and other allowance.as per ESI act Regards, Pushparaj

Yes you need to pay ESI contributions till March,because the contribution period is from October to March.
