shops & establishment act

I am working in the corporate office of a Ltd company. I would like to know whether corporate office comes under Shops & Establishment Act or Industrial Relation Act/Factory Act. if it is shops & establishment, is there anyone who can tell me wht is shops & establishment act and the site on which it is available.

Hi,

Any corporate office functioning seperatly from factory are covered under Shop and Establishment act,1948. If corporate office attached to a factory then it comes under factories act.

Your corporate office comes under the definition of : "Commercial Establishment", if you want to have shops and Commercial Establishment Bare Act u should tell the adress and location , because there are state specific S @ E Act.

Dear,

This is actually statewise and your corporate office should have registered. You need to take a license to run your mall,shop,Commertial Estb issued by the Municipality Office with application form,shop layout,fee draft,NOC from Landlord.
Tel me your company and you may search on Google for the same by mentioning state name in the last.

The corporate offices will be normally in the nature of 'commercial establishments' in which case the Shops and Establishments Act will be applicable. This is an state specific Act and hence, the provisions will differ from one state to another.

Secondly, for the establishments covered under the Shops and Establishments Act, other allied legislations, like Minimum Wages Act, Payment of Bonus Act, etc. will be applicable. Applicability of these legislations depends upon the location, the no. of employees, the nature of industry, etc. in the establishment.

Further, certain legislations contemplate branches but some legislations do not.

I wanted to know about the overtime policy and weekend working policy and working on National Holidays and other Holidays given in holiday list.
